Alayna case, sexual assault process, resources
ASU takes all reports of sexual assault seriously, investigate them thoroughly, and make determinations based on the evidence and facts obtained during the ASU investigatory process.
Sexual assaults on an ASU campus are investigated on a criminal basis by the ASU Police Department. Sexual assaults involving students on or off campus are subject to investigation by either ASU Student Rights and Responsibilities or ASU University Rights and Responsibilities.
In order to support individuals who make reports of sexual assault, ASU offers each individual a victim advocate to assist and support them throughout the investigatory processes. The case currently in question has been thoroughly investigated by the ASU Police Department, which determined there was insufficient evidence to refer the case to the Maricopa County Attorney for criminal prosecution.
While this case is closed, if new evidence or facts are brought forward, it can be reopened.
The university understands that sexual assault investigations can be a complicated and emotional process, no matter the outcome of the investigation. The matter currently being discussed on social media demonstrates that to be the case. We empathize with individuals who have been traumatized by sexual assault and harassment and whose lives have been impacted in many ways by those events. We have provided all documentation and records pertaining to this case to the individual appearing in the video as well as her attorney. We have also made outreach attempts to the individual in the video, and ASU support services continue to be available to her.
ASU encourages members of the ASU community to report to the university any experiences of sexual assault. ASU’s support system for victims of sexual assault is robust — it includes victim advocates, counseling services and services through student advocacy and assistance. University policies, procedures and resources to support students can be found at https://sexualviolenceprevention.asu.edu/. ASU also offers peer support services through the Sun Devil Support Network - https://eoss.asu.edu/sdsn. Records associated with closed police cases are public information and can be requested through ASU Police.
